سپریم کورٹ نے بانی پی ٹی آئی اور سابق وزیر اعظم عمران خان کی نو مئی کے واقعات سے متعلق درج کیے گئے آٹھ مقدمات میں ضمانت منظور کرلی ہے۔
چیف جسٹس یحییٰ آفریدی کی سربراہی میں تین رکنی بینچ نے لاہور ہائی کورٹ کے فیصلوں کے خلاف اپیلوں کی سماعت کی۔ عدالت نے مختصر دلائل سننے کے بعد عمران خان کی آٹھ مقدمات میں ضمانت کی درخواستیں منظور کرلیں۔
تاہم یاد رہے کہ ان آٹھ مقدمات میں ضمانت ملنے کے باوجود عمران خان جیل سے رہا نہیں ہو سکیں گے کیونکہ انھیں ایک سو نوے ملین پاؤنڈ میں چودہ سال قید کی سزا ہو چکی ہے۔
جبکہ توشہ خانہ ٹو میں ان کی گرفتاری ڈالی جاچکی ہے۔ ایک سو نوے ملین پاؤنڈ کے مقدمے کے فیصلے کو عمران خان کے وکلا نے اسلام آباد ہائی کورٹ میں چیلنج کر رکھا ہے۔
سپیشل پراسیکیوٹر ذوالفقار نقوی نے دوران سماعت دلائل دیتے ہوئے کہا کہ نو مئی کے واقعات کے احکامات عمران خان نے دیے تھے۔
انھوں نے کہا کہ یہ آٹھ مقدمات انسداد دہشت گردی کی عدالتوں میں زیر سماعت ہیں۔
انھوں نے کہا کہ دو سال سے مخلتف عدالتوں نے ان کی ضمانت کی درخواستیں مسترد کی ہیں۔
چیف جسٹس کا کہنا تھا کہ عدالت مقدمے کے ٹرائل میں نہیں جائے گی اور صرف ضمانت کی حد تک معاملے کو دیکھے گی۔
انھوں نے پراسیکیوٹر سے استفسار کیا کہ اس سے مقدمے میں عمران خان کے خلاف کون سے ثبوت ہیں جس پر عدالت کو بتایا گیا کہ اس معاملے میں تین گواہان کے بیانات بھی ریکارڈ پر موجود ہیں۔
عدالت نے استفسار کیا کہ اس سے پہلے سابق سینیٹر اعجاز چوہدری کی بھی نو مئی کے مقدمے میں ضمانت منظور کی تھی اور اب پراسیکوشن یہ بتائے کہ یہ کیس اعجاز چوہدری کے کیس سے الگ کیسے ہے؟
پراسیکوشن اس معاملے میں عدالت کو تسلی بخش جواب نہ دے سکے۔
پراسیکیوٹر کا کہنا تھا کہ عمران خان نے پولی گرافک ٹیسٹ بھی نہیں دیا اس لیے وہ ضمانت کے مستحق نہیں ہیں۔
بینچ میں موجود جسٹس اظہر حسن رضوی نے پراسیکوشن سے استفسار کیا کہ کیا اعجاز چوہدری نو مئی کے واقعات میں موقع پر موجود تھے جس پر پراسیکوٹر نے جواب دیا کہ وہ اس بارے میں کچھ نہیں کہہ سکتے۔
عدالت نے پراسیکیوٹر کو مخاطب کرتے ہوئے کہا کہ ان کے پاس بنیادی معلومات ہی نہیں ہیں۔
عمران خان کے وکیل کے دلائل
عدالت نے عمران خان کے وکیل سلمان صفدر کو دلائل دینے کا حکم دیا اور انھوں نے دلائل دیتے ہوئے کہا کہ عمران خان ان آٹھ مقدمات میں سے پانچ مقدمات میں نامزد ہی نہیں ہیں۔
انھوں نے کہا کہ پراسیکیوشن نے اس حوالے سے متعلقہ عدالت میں چالان پیش کیے ہیں۔
انھوں نے کہا کہ لاہور ہائی کورٹ میں بھی ضمانت کی درخواستوں میں یہی موقف اختیار کیا تھا لیکن ان کا موقف تسلیم نہیں کیا گیا۔
عمران خان کے وکیل کا کہنا تھا کہ ضمانت پر ملزم کا حق ہے اور ان کے موکل کو دو سال تک اس حق سے محروم رکھا گیا۔ عدالت نے مختصر دلائل سننے کے بعد عمران خان کی آٹھ مقدمات میں ضمانت کی درخواستیں منظور کرلیں۔
یاد رہے اس سے قبل عمران خان کی ضمانتوں کی درخواستیں سننے والا بینچ تبدیل بھی ہوا۔ تین رکنی بینچ میں جسٹس میاں گل حسن اورنگزیب کی جگہ جسٹس حسن اظہر رضوی کو شامل کیا گیا۔
